1. Who We Are

Blenc is an AI-powered outfit matching mobile application. These Terms of Service govern your use of the Blenc app and the services accessible through it, including the website at blencai.com.

When these Terms refer to "Blenc", "we", "our", or "us", we mean the Blenc service and its operator. When we refer to "you" or "user", we mean the individual accessing or using the app.

2. Eligibility

You must meet the following requirements to use Blenc:

• You must be at least 13 years of age.
• If you are between 13 and 18 years old, you confirm that you have obtained parental or guardian consent to use this app.
• You must have the legal capacity to enter into a binding agreement under the laws of your jurisdiction.
• Your use of Blenc must not violate any applicable law or regulation.

By using the app, you represent and warrant that you meet all eligibility requirements. We reserve the right to terminate accounts that do not meet these requirements.

3. Your Account

You may use certain features of Blenc without an account. However, saving favourites and accessing your history across devices requires account registration.

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Keep your password confidential and secure
• Not share your account credentials with any other person
• Notify us immediately of any unauthorised access to your account
• Take responsibility for all activity that occurs under your account

We are not liable for any loss or damage arising from your failure to protect your account credentials. One person may not maintain more than one account. Accounts created through automated means are prohibited.

4. Acceptable Use

Blenc is provided for personal, non-commercial use only. You may use Blenc to:

• Photograph or upload images of your own clothing items
• Receive AI-generated outfit matching suggestions
• Browse and purchase products through affiliate links
• Save and manage your favourite products and analysis history

You may not use Blenc for any commercial purpose, including reselling access to the service, using it to build a competing product, or systematically extracting data from the service.

5. Prohibited Conduct

You agree not to:

• Upload images that are offensive, obscene, illegal, or that infringe on anyone's rights
• Attempt to reverse engineer, decompile, or extract the source code of the Blenc app or its AI models
• Use automated scripts, bots, or other tools to access the service at a rate that exceeds normal human use
• Attempt to circumvent, disable, or interfere with any security features or rate limits of the app
• Use the app in any way that could damage, disable, overburden, or impair our servers or networks
• Probe, scan, or test the vulnerability of any system or network connected to Blenc
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use Blenc to collect or harvest personal data about other users
• Violate any applicable local, national, or international law or regulation

6. AI-Generated Content and Accuracy

Blenc uses artificial intelligence — specifically OpenAI's GPT-4o Vision model — to analyse clothing items and generate outfit suggestions. You acknowledge and agree that:

• AI-generated outfit suggestions are for informational and entertainment purposes only and do not constitute professional fashion, styling, or retail advice
• The accuracy of colour detection, garment classification, and style matching depends on image quality, lighting conditions, and the limitations of AI technology
• AI analysis results may contain errors, inaccuracies, or inappropriate suggestions
• Product prices, availability, and specifications shown in the app are sourced from third-party services and may not reflect current real-world conditions
• We do not guarantee that suggested outfits will meet your personal style preferences or be appropriate for any specific occasion

You use AI-generated suggestions entirely at your own discretion. We are not responsible for any purchasing decisions made based on Blenc's suggestions.

7. Affiliate Links and Third-Party Products

Blenc displays product recommendations from third-party e-commerce platforms including Flipkart, Amazon India, Myntra, and AJIO. We may earn a commission when you purchase a product through a link in the app. This affiliate relationship does not affect the price you pay.

By using Blenc, you acknowledge that:

• Product listings, prices, and availability are sourced from Google Shopping and may not always be accurate or current
• When you tap a product link, you are redirected to a third-party platform governed by that platform's own terms and privacy policies
• Blenc is not a party to any transaction between you and a third-party retailer
• We make no warranties regarding the quality, safety, legality, or accuracy of products listed by third-party retailers
• Any disputes regarding purchases must be resolved directly with the relevant retailer

We reserve the right to change, remove, or update affiliate partnerships at any time without notice.

8. Intellectual Property

All intellectual property in the Blenc app — including but not limited to the name "Blenc", the logo, the hanger icon, the app design, UI elements, colour system, code, and AI prompt architecture — is owned exclusively by Blenc and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Blenc app for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, reproduce, or distribute any part of the app or its content
• Use the Blenc name, logo, or branding without prior written permission
• Create derivative works based on the app or its AI systems
• Remove or alter any proprietary notices or labels in the app

Nothing in these Terms transfers any intellectual property rights to you. All rights not expressly granted are reserved.

9. User-Uploaded Content

When you upload or capture images using Blenc, you retain ownership of those images. However, by using the service, you grant us a limited, worldwide, royalty-free licence to transmit your images to our AI processing pipeline solely for the purpose of providing the garment analysis service to you.

You represent and warrant that:

• You own or have the right to use any images you upload
• Your images do not contain content that is illegal, obscene, defamatory, or that infringes any third party's rights
• You will not upload images of other people without their consent

We do not store your uploaded images on our servers. Images are transmitted to OpenAI for analysis only and are subject to OpenAI's data handling policies. We are not responsible for how OpenAI processes your images.

10. Privacy

Your use of Blenc is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Blenc, you consent to the collection and use of your information as described in the Privacy Policy.

11. Service Availability

We provide Blenc on an "as available" basis. We do not guarantee that the service will be available at all times, uninterrupted, or error-free. We may:

• Suspend, restrict, or terminate the service at any time for maintenance, upgrades, or any other reason
• Modify, add, or remove features of the app without prior notice
• Impose usage limits to protect service quality for all users
• Discontinue the service entirely with reasonable notice where practicable

The service relies on third-party APIs including OpenAI and SerpAPI. We are not liable for interruptions caused by these third-party services.

The daily search limit in the app exists to protect service quality and API resources. We reserve the right to adjust these limits at any time.

12. Disclaimer of Warranties

We expressly disclaim all warranties including but not limited to:

• Merchantability — we do not warrant that the service is fit for any particular purpose
• Accuracy — we do not warrant that AI-generated outfit suggestions, colour analyses, or product information are accurate or complete
• Uninterrupted access — we do not warrant that the service will be available at all times or without delays
• Security — while we implement security measures, we cannot guarantee the service is entirely free from vulnerabilities
• Third-party content — we make no warranties regarding products, services, or content provided by third-party retailers or APIs

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

13. Limitation of Liability

This includes but is not limited to:

• Loss of data or content
• Financial loss resulting from purchases made based on AI-generated recommendations
• Losses arising from third-party retailer transactions
• Loss of profits or business opportunities
• Losses arising from service interruptions or unavailability
• Losses arising from unauthorised access to your account

In any event, our total liability to you for all claims arising from your use of Blenc shall not exceed the amount you have paid us in the twelve months preceding the claim. Since Blenc is currently free to use, this amount is zero.

Some jurisdictions do not allow the limitation of liability for consequential damages, so the above limitation may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Blenc and its operators, affiliates, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with:

• Your access to or use of Blenc
• Your violation of these Terms of Service
• Your violation of any third-party rights
• Any content you upload to the app
• Any transaction you enter into with a third-party retailer through Blenc's affiliate links

15. Account Termination

You may terminate your account at any time by going to Profile → Delete account in the app. This permanently deletes your account and all associated data.

We may suspend or terminate your account immediately and without prior notice if we determine, in our sole discretion, that:

• You have violated these Terms of Service
• Your conduct poses a risk to other users or to the service
• You have provided false information during registration
• Your account has been inactive for an extended period and we need to manage server resources
• We are required to do so by law or a regulatory authority

Upon termination, your right to use Blenc immediately ceases. We are not liable to you or any third party for termination of your account in accordance with these Terms.

Sections 8 (Intellectual Property), 12 (Disclaimer of Warranties), 13 (Limitation of Liability), and 14 (Indemnification) survive any termination of these Terms.

16. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. When we make material changes, we will update the effective date at the top of this page.

Your continued use of Blenc after the updated Terms are posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the app and may delete your account.

We encourage you to review these Terms periodically. For significant changes, we will make reasonable efforts to notify you through the app or via email.

17. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms or your use of Blenc shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, it shall be subject to the exclusive jurisdiction of the courts located in India.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the rest of these Terms remain in full force and effect.
